• The use of UPOINT Remote Web Publisher mainly as an archive tool. This include excessive use of any file upload feature mainly for  uploading images, music, documents or other files to image/music galleries, warez sites, file archive centers or websites in such nature.
• The use of UPOINT Remote Web Publisher with system and network abuse intention. Any attempt to undermine or overcome UPOINT's server security is strictly prohibited and may result in immediate account cancellation.
• The use of UPOINT Remote Web Publisher in cases where the login info to this service is publicly announced.
• The use of UPOINT Remote Web Publisher publicly as an online demo.

UPOINT will be the sole arbiter as to what constitutes a violation of this provision. We reserve the right to refuse, cancel or suspend service at our sole discretion.

Warranty Disclaimers
UPOINT is not responsible for any loss of data from service interruptions or malfunctions, whether caused by the hardware fault, software deficiency or your own errors. You specifically agree that you shall make no claims against UPOINT arising from such issues.

Limited Liability
You agree to indemnify and hold harmless UPOINT from any claim resulting from the use of this service that results in claims by a third party or a violation of law. Such indemnification shall include reimbursement of all UPOINT’s costs and legal fees incurred in connection therewith.

Contents Disclosure
UPOINT will not disclose the contents of your account to any third party at all time. Neither will we grant any third party access to your account or server. The only exception is in cases where you request UPOINT to troubleshoot technical errors encountered in your account.

Money-Back Guarantee
UPOINT is pleased to offer a money-back guarantee (except for the 1-month P0000T Trial Account) within 30 days of your Paid Account signup should we fail to provide a satisfactory service.

Refund
Pro-rated refund will be given if it is found that the service is practically not useable due to hardware or software errors or in cases where UPOINT fails to continue providing the service. We will not be responsible for any fees that you charge your customers or your time and effort spent in overcoming any error occurred.

Currency
Unless otherwise specified, all transactions are in US dollars.

Payment
You shall pay in advanced a service fee as stated at our website. Your account is in default if payment is not received after the renewal date. Under such circumstances UPOINT reserves the right to terminate the account.

Prices Adjustment
UPOINT reserves the rights to adjust any or all prices. Before any upward increment (in case there is), existing users will be given at least five (5) working days to upgrade their plans at old rates. If the users decide to stay at the same plans, the users will continue to enjoy the same old rates for their existing plans as long as the accounts continue to stay active.

Free Account
UPOINT reserves the rights to discontinue the provision of free services to new or existing accounts at anytime. In such case UPOINT will attempt to notify the users.
